These Terms and Conditions shall apply to the purchase and sale of services (booking of
sports activities) via the KickOff Sports ApS platform (website, mobile applications, and
other digital media, hereinafter collectively the "Platform" or the "App").
By accessing and using the Platform and/or by participating in any activity or programme
organised by KickOff Sports ApS ("KickOff") or via the Platform, the user (the "User")
confirms, acknowledges, and accepts to be bound by all of these Terms.
1. Acceptance, Validity, and Basis of Agreement
1.1. These Terms and Conditions constitute a legally binding agreement between the
User, whether acting personally or on behalf of a legal entity, and KickOff Sports
ApS.
1.2. KickOff reserves the right, at its sole discretion, to make changes and/or
modifications to these Terms, which entails that:
a) The User will be notified of material changes by the revision of the "Last
update" date.
b) The User undertakes to review the current Terms & Conditions whenever
using the App.
c) The User's continued use of the App and participation in activities after the
date of publication of the revised Terms constitutes an automatic and
unequivocal acceptance of the changes.
2. Prices and Payment Terms
2.1. All prices stated on the Platform are in Danish Kroner (DKK) and are inclusive of
applicable VAT, unless explicitly stated otherwise. Any fees for transactions or
payment cards will be clearly visible at checkout.
2.2. Payment is made via approved payment cards, e.g., Visa, MasterCard,
MobilePay, Apple Pay, or Google Pay. The payment transaction is handled by a
third-party payment provider.
2.3. The amount for the booked activity is withdrawn immediately upon booking.
3. Conclusion of Agreement
3.1. A binding agreement between the User and KickOff is concluded when the User
has completed the payment and received a written confirmation of their booking.
4. Right of Withdrawal (Derogation)
4.1. As the booking of sports activities is a service relating to leisure activities which
is provided on a specific date or within a specific period, the agreement
is NOT covered by the statutory 14-day right of withdrawal pursuant to the
Danish Consumer Contracts Act (Forbrugeraftaleloven).
5. Cancellation by the User
5.1. The User's cancellation of a booking can only take place in accordance with
KickOff's cancellation policy, which is set as follows:
a) If the User cancels at least 24 hours before the booked activity's start time,
the full amount paid for the activity will be converted to Credits. These Credits
constitute an amount due that can only be used for future bookings on the
KickOff Platform.
b) If the User cancels later than 24 hours before the booked activity's start time,
the amount paid for the activity is forfeited entirely.
c) If the User fails to attend the activity, the User is obliged to pay the full
booking amount, and no refund or Credit will be issued.
d) KickOff does not provide any cash refund of amounts paid, and Credits
cannot be converted into a cash refund.
6. Cancellation by KickOff
6.1. In the event that KickOff is forced to cancel an activity (e.g., due to weather
conditions, insufficient number of participants, damage to facilities, or other
unforeseen circumstances), the User will without undue delay be offered either
a full refund of the amount paid or rebooking to a corresponding activity.
7. Age Requirement
7.1. The Platform is intended exclusively for Users who are 18 years of age or older.
Persons under 18 years of age are excluded from registering, using the Platform,
or participating in activities facilitated via KickOff.
7.2. Organisers (Match Hosts) reserve the right to refuse participation to any person
who does not meet the age requirement.
7.3. Failure to comply with this Age Requirement may result in the immediate
suspension or termination of the User's account and the forfeiture of any prepaid
fees.
8. Data Protection and Privacy
8.1. KickOff processes the User's personal data (name, contact information, payment
data, and activity data) in accordance with applicable legislation, including the
General Data Protection Regulation (GDPR).
8.2. The processing of necessary information to provide and administer the booking
(performance of the agreement) and the App service takes place pursuant to
GDPR Article 6(1)(b).
8.3. To ensure transparency and compliance with the duty of information, the User is
referred to KickOff’s current Privacy Policy for details on purpose, retention
period, User rights, security measures, and any disclosure of information.
8.4. The Privacy Policy is available at [Insert link] and constitutes an integrated part of
these Terms and Conditions.
9. User Representations
9.1. By using the App, the User represents and warrants that:
a) All submitted registration information is truthful, accurate, current, and
complete.
b) The User will continuously update this information.
c) The User will not access the Platform using automated or non-human means
(e.g., scripts, bots, or similar).
d) The use of the App is exclusively for lawful and authorised purposes.
10. Health and Physical Fitness
10.1. The User declares that they are physically and medically fit to participate in the
sporting activities booked via the Platform. The User declares that participation
has not been advised against by a doctor or healthcare professional.
11. Compliance with Rules and Safety
11.1. The User undertakes to comply with all applicable rules for the respective
activities, including facility rules and KickOff’s Code of Conduct [insert link here].
11.2. The User is solely responsible for assessing the facilities, equipment, and
surroundings for safety prior to participation.
11.3. If the User deems the conditions unsafe, the User must immediately inform
KickOff representatives and refrain from participation until the conditions are
corrected.
12. Assumption of Risk
12.1. The User acknowledges that participation in sports and physical activities
unconditionally entails a risk of personal injury, including serious injury and
permanent disability, as well as the accompanying risk of loss of property and
financial losses.
12.2. The User agrees to participate at their own risk and assumes full responsibility
for their participation, regardless of whether the injury arises as a result of simple
negligence on KickOff's part.
13. Limitation of Liability
13.1. On their own behalf, and on behalf of heirs and assigns, the User releases, and
hereby agrees not to sue, KickOff Sports ApS, its employees, affiliated
companies, sponsors, and owners of the activity facilities (the "Released
Parties").
13.2. This release includes any liability for personal injury, illness, loss, or damage that
may arise in connection with the User's participation. The limitation of liability
shall not, however, apply to losses that may result from gross negligent acts or
intent on the part of KickOff.
14. Indemnification Against Third-Party Claims
14.1. The User undertakes to indemnify and hold KickOff Sports ApS harmless from
any and all claims, losses, liabilities, and expenses from third parties that may
arise based on or in connection with the User's conduct or participation in
activities arranged via KickOff.
15. Medical Consent
15.1. The User grants consent for necessary first aid or medical treatment to be
initiated towards the User in the event of injury or illness during the activity. The
User releases KickOff and all involved persons from any liability in connection
with the execution of such treatment.
16. User Responsibility for Property Damage
16.1. The User is solely liable for any damage the User causes to third-party property,
including sports facilities, equipment, or personal belongings. KickOff is not
responsible for damage, loss, or destruction of property belonging to the User or
third parties.
17. Insurance Coverage
17.1. KickOff does not purchase or provide insurance coverage for damage caused by
the User. The User must arrange for appropriate insurance coverage
themselves.
18. Ownership and License
18.1. The Platform, its source codes, databases, software, designs, and all content
(collectively the "Content") belong to KickOff or are licensed to KickOff. The
Content is protected by applicable intellectual property law.
18.2. The User is granted a limited, non-exclusive license to access and use the
Platform exclusively for personal, non-commercial use. The User may not copy,
reproduce, or commercially exploit any part of the App or the Content without
prior written permission from KickOff.
18.3. By creating or uploading content, data, text, images, team names, chat
messages, or other material on the Platform ("User Content"), the User grants
KickOff a royalty-free, perpetual, irrevocable, worldwide, non-exclusive license to
use, reproduce, modify, publish, distribute, and display this User Content in
connection with the operation and marketing of the Platform and KickOff's
activities.
18.4. The User represents and warrants that they either own or have the necessary
licenses and rights to grant KickOff the license described in 18.3, and that the
User Content does not infringe the rights of third parties or applicable legislation.
19. Prohibited Activities
19.1. The User expressly undertakes not to:
a) Conduct systematic data collection or data extraction (scraping, bots) without
written permission.
b) Attempt to circumvent or disable security features.
c) Upload or transmit viruses or other harmful material.
d) Use the App to compete with KickOff or for commercial purposes.
e) Decompile, reverse engineer or otherwise attempt to derive the source code.
f) Sell or transfer their profile or account.
20. Use of Media Material
20.1. The User grants KickOff the right to use photo, video, and audio recordings in
which the User may be included, and which were recorded during activities,
for marketing, communication, and documentation purposes. KickOff undertakes
to process the material in accordance with applicable data protection legislation.
21. Communication Consent
21.1. By registering, the User consents to receive service messages (SMS and push
notifications) related to booked activities (e.g., reminders, changes, or
cancellations). The User may opt-out of these service messages at any time via
the App's settings.
22. Termination of Access
22.1. These Terms shall remain in full force and effect while the User uses the
Platform. KickOff reserves the right, at its sole discretion and without notice or
liability, to deny access to the Platform and activities (including blocking of IP
addresses) for any breach of these Terms or applicable legislation.
23. Consequences of Termination
23.1. Upon KickOff's termination or suspension of the User's account, the User is
excluded from registering and creating a new account under their own name or a
false name.
23.2. Upon termination or suspension of the User's account pursuant to 23.1 due to a
breach of these Terms and Conditions, the User forfeits their right to a refund of
any prepaid fees, credits, or unused amounts remaining in the User's account.
24. Force Majeure (Independent Events)
24.1. KickOff Sports ApS shall not be liable for failure or delay in the performance of its
obligations under these Terms and Conditions caused by circumstances beyond
KickOff’s reasonable control ("Force Majeure").
24.2. Force Majeure includes, but is not limited to, war, terrorist attacks, natural
disasters, fire, flood, weather conditions making safe activity impossible,
pandemics, strikes, quarantine measures, public restrictions, import or export
prohibitions, power outages, and major technical failures affecting the Platform's
operation.
24.3. In cases of Force Majeure, KickOff Sports ApS is exempt from any liability for
damages to the User. The agreement is considered to be breached without fault
on KickOff's part.
25. Interruptions and Changes to the Service
25.1. KickOff does not guarantee that the Platform will be available at all times. KickOff
reserves the right to change, revise, suspend, or discontinue the Platform (or
parts thereof) at any time without notice. KickOff is not liable for damages for
loss, injury, or inconvenience caused by temporary lack of access to the
Platform.
26. Disclaimer of Warranties
26.1. The App is provided "as is" and " available". The User's use of the App is at
their own risk and responsibility. KickOff disclaims, to the fullest extent permitted
by law, all warranties, express or implied, in connection with the App.
27. Claims and Complaints
27.1. If the User experiences defects in the service provided, a claim must be made
immediately after the end of the activity to KickOff's customer service via email
info@kickoff.dk
27.2. The User has the opportunity to submit a complaint about a purchase with us to
the Center for Complaint Resolution / Danish Appeals Boards Authority
(Nævnenes Hus), if the User cannot achieve a satisfactory resolution with
KickOff.
28. Severability
28.1. If any provision of these Terms and Conditions is declared unlawful, void, or
unenforceable, the provision in question shall be deemed severable from the
Terms, and its invalidity shall not affect the validity and enforceability of the
remaining provisions.
29. Governing Law and Jurisdiction
29.1. These Terms and Conditions shall be construed and governed in accordance
with Danish law. Any dispute arising out of or in connection with these Terms
shall be settled by the Danish courts as the venue.
